1. Introduction

We appreciate your interest as a user (“you” or the “user”) in the LoadFox platform operated by LoadFox GmbH (“we” or “LoadFox”) at loadfox.eu (the “Platform”). In this privacy policy (the “Privacy Policy”) we would like to inform you how we collect, process and use your personal data (the “Personal Data”) collected through our platform. Furthermore, this data protection declaration will inform the persons concerned about their rights. In doing so, we observe the data protection provisions of the Data Protection Ordinance (GDPR), the Federal Data Protection Act (BDSG) and other laws. The protection of privacy as well as the protection of our users is of particular importance to us.
Should this data protection declaration be updated or otherwise changed by us in the future, we will inform you of this on this page. The person responsible pursuant to Art. 4 para. 7 of the EU Data Protection Basic Regulation (GDPR) is

2. Data collection and processing

2.1 Collection of anonymous user data when using our websites outside your user account

The website of LoadFox GmbH collects a number of general data and information each time a person concerned or an automated system accesses the website. We may collect (1) browser types and versions used, (2) the operating system used by the accessing system, (3) the Internet pages from which an accessing system accesses our website (so-called referrers), (4) the subwebsites which are accessed via an accessing system on our website, (5) the date and time of an access, (6) an Internet protocol address (IP address), (7) the Internet service provider of the accessing system, (8) technical information on the visit (e.g. http method, http version, http status code, length of transmitted data) and (9) other data and information used to avert dangers in the event of attacks on our information technology systems.

This information is anonymized and evaluated for statistical purposes. As an individual user you remain anonymous and LoadFox does not draw any conclusions about the person concerned. This information is needed to (1) correctly deliver the content of our website, (2) optimize our content and offerings, (3) ensure the long-term functionality of our information technology systems and the technology of our platform, and (4) provide law enforcement authorities with the necessary information in the event of a cyber attack. The anonymous data of the server log files are stored separately from all personal data provided by the person concerned.

The legal basis for this processing is the necessity to safeguard our legitimate interests according to Art. 6 para. 1 f) GDPR.

2.2 Data collection and processing during registration

The person concerned has the possibility to register himself and his company on the website of LoadFox GmbH by providing personal data. Which personal data is transmitted to LoadFox GmbH in this case, results from the respective input mask. The entered data is collected and stored exclusively for internal use and for our own purposes. LoadFox GmbH can arrange for the data to be passed on to one or more data processors, who also use the data exclusively for internal use, which is attributable to dm as the data controller.

We process this personal data for your registration as a user of the platform and for your future use of the platform as a registered user (see section 2.3 below).

The legal basis for this processing is the necessity for the fulfilment of a contract or for the implementation of pre-contractual measures pursuant to Art. 6 para. 1 b) GDPR.

2.3 Credit assessment of the user

For the purpose of credit assessment, CRIF Bürgel GmbH, Leopoldstraße 244, 80807 Munich, Germany, or Coface Central Europe Holding AG, Marxergasse 4c, 1030 Vienna, Austria, will provide us with the address and creditworthiness data stored in their database relating to your company, provided that we have substantiated our legitimate interest and there is no reason to believe that you have a legitimate interest in the exclusion of the transfer. The stored address and creditworthiness data are data that can be proven to be relevant for the calculation of a probability value based on a scientifically recognised mathematical-statistical procedure for the calculation of the probability of the particular behaviour. For the calculation of the probability value, address data are not exclusively used.

The legal basis for the comparison of address and creditworthiness data with the above-mentioned partners is Art. 6 Para. 1 b) and Art. 6 Para. 1 f) GDPR. Transmissions on the basis of Art. 6 Para. 1 f) may only take place if this is necessary to safeguard the legitimate interests of LoadFox GmbH or third parties and does not outweigh the interests and fundamental rights of the person concerned who demand the protection of personal data. The exchange of data with CRIF Bürgel und Coface also serves to fulfil legal obligations to carry out creditworthiness checks of customers (§ 505 a and 506 BGB). Our legitimate interest is our security and that of our other clients in the initiation of business transactions and the reduction of default risks. CRIF Bürgel processes the data received and also uses them for the purpose of scoring, in order to provide its contractual partners in the European Economic Area and in Switzerland as well as any other third countries (insofar as a European Commission decision on adequacy exists with regard to these) with information for the assessment of the creditworthiness of natural persons, among other things. 2.4 Data collection and processing when using the platform as a registered user

As a registered user using the platform by logging into your user account, we collect and process the following personal data in addition to section 2.2 above: user profile picture if applicable, contact details for cargo offered or accepted, search behaviour, information about you in connection with the conclusion and execution of freight contracts for cargo stated on the platform (including payment processing), and data about routes travelled.

The legal basis for this is Art. 6 para. 1 b) GDPR.

3. Data transfer to third parties

We will only pass on your personal data to third parties in the following cases:

3.1 Transmission to other users of the platform

To the extent necessary for the use of the platform (in particular for the handling of freight and the conclusion of freight contracts), your personal data – in particular your contact data – may also be forwarded to other users of the platform (e.g. your freight partners). Further details can be found in the “General Terms and Conditions for the Use of the LoadFox Platform” concluded between you and us.

The legal basis is Art. 6 para. 1 b) GDPR.

3.2 Transmission to Loadfox service providers

Your personal data and usage data will only be transmitted to Loadfox service providers within the scope of what is necessary (e.g. if necessary in the future integrated TMS (transport management system) / FMS (fleet management system) providers, telematics providers, scheduling software of our major customers and MAN Group companies (in particular for the RIO Services)) if corresponding services are to be provided.

The legal basis for this is Art. 6 para. 1 b) GDPR.

3.3 Credit assessment

To the extent permitted by law and taking into account the respective interests worthy of protection in the exclusion of transmission or use, we may forward and request your address and creditworthiness data to CRIF Bürgel GmbH, Raldkoferstraße 2, 81373 Munich, Germany or Coface Central Europe Holding AG, Marxergasse 4c, 1030 Vienna, Austria, for creditworthiness and credit checks.

The legal basis for the comparison of address and creditworthiness data with the above-mentioned partners is Art. 6 para. 1 f) GDPR. Our legitimate interest is our security and that of our other customers in the initiation of business and the reduction of potential non-payment risks.

3.4 Transmission to state institutions and government agencies

Personal data will only be transferred to state institutions and government authorities within the framework of mandatory legal provisions.

The legal basis here is Art. 6 para. 1 c) GDPR.

4. Data collection through web analysis services

4.1 Google (Universal) Analytics

The platform uses Google (Universal) Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of the platform (including your IP address) will generally be transmitted to and stored by Google on servers in the United States. Google has submitted to the EU-US Privacy Shield (https://www.privacyshield.gov/EU-US-Framework).

We would like to point out that the code “_anonymizeIp” has been added to the Google Analytics platform in order to guarantee the anonymous collection of IP addresses (so-called IP masking). On behalf of LoadFox, Google will use this information to evaluate your use of the platform, to compile reports on platform activity for LoadFox and to provide other services related to platform and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. The IP address transmitted by your browser within the scope of Google Analytics is not combined with other Google data. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of the website.

The legal basis for the processing is the necessity to safeguard our legitimate interests pursuant to Art. 6 para. 1 f) GDPR, namely our interest in the statistical evaluation of the usage behaviour of our website users.

4.2 Inspectlet

This website uses “Inspectlet”, a web analysis service of the provider Inspectlet. Inspectlet enables an analysis of the user behaviour of our website (e.g. mouse movements and clicks, scrolling, behaviour in form fields). In addition, Inspectlet uses “cookies”, which are text files placed on your computer, to help the website analyze how users use the site (for example, what content is clicked on on the site). No personal data is collected, processed or used from you, only user profiles are created by using pseudonyms. The pseudonymised user profiles are not combined with personal data about the bearer of the pseudonym without the express consent of the person concerned. In addition, information may be transferred to third parties if this is required by law or if third parties process this data on behalf of Inspectlet.

You may at any time object to the collection, processing and recording of data generated by the Inspectlet analysis service by following the instructions at http://www.inspectlet.com/optout.

The legal basis for the processing is the necessity to safeguard our legitimate interests pursuant to Art. 6 Para. 1 f) GDPR, namely our interest in the statistical evaluation of the usage behaviour of our website users.

5. Cookies

The internet pages of LoadFox GmbH use cookies. Cookies are small text files which are stored on your computer by your browser. Cookies do not damage your computer and do not contain viruses. Cookies contain a so-called cookie ID, which is a unique identifier of the cookie. It consists of a string of characters through which Internet pages and servers can be assigned to the specific Internet browser in which the cookie was stored. This enables the visited Internet pages and servers to distinguish the individual browser of the person concerned from others. Most browsers are set to automatically accept cookies. However, you have the option of deactivating this function in your browser. LoadFox uses cookies to make the site more user-friendly, effective and secure. Our cookies do not contain any personal information. With the exception of the cookies mentioned in section 4, the cookies we use are so-called “session cookies”. They are automatically deleted at the end of your visit.
Of course, you can also view our platform without cookies; however, this can lead to functional limitations of our offers.

The person concerned can prevent the setting of cookies by our Internet pages at any time by means of an appropriate setting of the Internet browser used and permanently object to the setting of cookies. Furthermore, cookies that have already been set can be deleted at any time via an Internet browser or other software programs. 6. Newsletter and remarketing/retargeting

On the website of LoadFox GmbH, users are given the opportunity to subscribe to the newsletter of our company. The personal data transmitted to LoadFox GmbH when ordering the newsletter is determined by the input mask used for this purpose.

The LoadFox GmbH informs its customers and business partners in regular intervals by means of a newsletter about the offers and services of the company. If you register to receive our newsletter, we need a valid e-mail address. After entering the e-mail address and confirming the consent text, you will receive an automated e-mail in which you confirm your consent again by clicking a link (double opt-in). To prove your consent, we store your e-mail address, the consent text, the confirmation e-mail, as well as the respective IP addresses, time and date of registration and confirmation.

The newsletter is sent via MailChimp, a newsletter distribution platform of the US provider Rocket Science Group, LLC, 675 Ponce De Leon Ave NE #5000, Atlanta, GA 30308, USA. The email addresses of our newsletter recipients, as well as other data described in this notice, are stored on MailChimp’s servers in the United States. MailChimp uses this information to send and evaluate newsletters on our behalf. MailChimp has submitted to the US-EU Privacy Shield and is thus committed to complying with EU data protection regulations. Furthermore, we have concluded a “Data Processing Agreement” with MailChimp. This is a contract in which MailChimp undertakes to protect the data of our users, to process it on our behalf in accordance with the data protection regulations and, in particular, not to pass it on to third parties.

You can object to the further sending of LoadFox newsletters at any time; your objection possibility and the recommended way to submit your objection will be indicated on the respective newsletter.

The legal basis for the processing here is your consent in accordance with Art. 6 Para. 1 a) GDPR.

As a user of the platform, you will receive regular recommendations on transport offers from us by e-mail. You will receive these recommendations on transport offers irrespective of whether you have subscribed to our newsletter or not. In this way, we want to provide you with information about cargo or freight space offers on our platform that might be of interest to you based on your company data or your latest transactions on LoadFox. If you no longer wish to receive transport offers from us, you can object to this at any time without incurring any costs other than the transmission costs according to basic tariffs. Please send an e-mail to support@loadfox.eu to do so.

In the event that we engage in future remarketing and/or retargeting (e.g. via Google or Facebook) in connection with your use of the platform, we will inform you of this on this page.

7. Social Media Plugins

On some of our pages plugins from social networks are integrated. Currently we use the Facebook plugin.

The plugin establishes a direct connection between your browser and the server of the respective social network as soon as you visit our website. This gives the network operator the information that you have visited our site with your IP address. The data transfer takes place regardless of whether you have an account with the respective network and are logged in there. If you are logged in to the network, your data collected by us will be directly assigned to your user account stored there. If you confirm the button and, for example, link the page, the network also stores this information in your user account and communicates it publicly to your contacts. We recommend that you log out regularly after using social networks.

Through the plugins we offer you the possibility to interact with social networks and other users, so that we can improve our offer and make it more interesting for you as a user.

The legal basis for the use of the plug-ins is Art. 6 para. 1 f) GDPR.

We have no influence on the collected data and data processing operations, nor are we aware of the full scope of data collection, the purposes of processing or storage periods. We also do not have any information on the deletion of the collected data by the respective network. Further information on this can be found in the data protection declaration of the respective network.

8. Integration of YouTube-Videos

We have included YouTube videos on our site that are stored at http://www.YouTube.com and can be played directly from our website. These are integrated in the “extended data protection mode”, i.e. no data about you as a user is transferred to YouTube if you do not play the videos. Only when you play these videos will the data mentioned in the next paragraph be transmitted.
We have no influence on this data transfer.

By visiting the website, YouTube receives the information that you have accessed the corresponding subpage of our website. This occurs regardless of whether YouTube provides a user account that you are logged in to or whether there is no user account. If you are logged in to Google, your information will be directly associated with your account. If you do not wish to be assigned in your YouTube profile, you must log out before activating the button. YouTube stores your data as user profiles and uses them for advertising, market research and/or for designing its website to meet your needs. You have the right to object to the creation of these user profiles, whereby you must contact YouTube to exercise this right.

9. Data security and links to third-party websites

Your data will be protected by Loadfox through technical and organizational security measures to avoid accidental or intentional manipulation, loss, destruction or access by unauthorized persons. Our security measures, such as data encryption, are regularly improved in line with technological developments.

However, we would like to point out that the transmission of your personal data via the Internet from you to the platform or from the platform to you (or to other users) may involve risks that lie outside our sphere of influence.

Our platform may contain links to websites of other providers to which this data protection declaration does not apply. Loadfox did not find any illegal contents on the directly linked pages at the time of setting the links. However, Loadfox has no influence whatsoever on the content of the linked pages and cannot monitor them continuously. Therefore Loadfox does not assume any liability for the contents of the linked pages which were changed after the link was set.

10. Rights of data subjects

You have the following rights towards us with regard to your personal data:

  • Right to correction or deletion,
  • Right to limit the processing,
  • Right to object to the processing,
  • Right to data transferability
